Property, Development & Construction

We act for private developers, listed and unlisted trusts, financial institutions, contractors, government, tenants and joint venturers in acquisitions and disposals, redevelopment, body corporates, syndication and leasing organisations.

This multi-disciplinary sector demands the attention of legal advisers who are well versed in project structuring and finance, planning and environment law, tax, capital raising, general commercial law, engineering and contract documentation, risk analysis and insurance.

In recent years, Middletons has gained recognition as one of Australia’s most reliable firms in providing a full suite of advice on construction contracts. We have particular accomplishments in large-scale construction projects in the energy and resources sector (oil, gas and coal, electricity generation and transmission), in telecommunications and in rail.

We place significant emphasis on ensuring that our clients fully understand the scope of their projects before becoming committed to them – thereby avoiding a common cause of disputes in this sector. We nevertheless have long experience in negotiation, mediation, arbitration and litigation of all types of construction-related matters.

Increasingly we are involved with private finance initiatives (PFI), and a public-private partnership (PPP) approach to major construction projects on the basis of build-own-operate-transfer (BOOT).
